Last week, the fascist-dominated U.S. Supreme Court voted 9-0 that the Trump administration should “facilitate” the return to the U.S. of Kilmar Armando Abrego Garcia. Garcia, a 29-year-old native of El Salvador and father of three, fled gang violence in his country and sought asylum in the U.S. in 2011. In 2019, an immigration court ordered that Garcia could NOT be sent back to El Salvador.
Nonetheless, in March, ICE agents pulled his car over, and within days—and without any hearing—he was on a plane with other men being deported to El Salvador’s CECOT torture prison. The U.S. government admits that it was an “error” to ship him there. But in the face of repeated orders from lower courts to bring him back, the Trump regime has claimed it is impossible to do so.

The Supreme Court’s ruling that the U.S. must “facilitate” Garcia’s return was mealy mouthed and unclear about what exactly the U.S. should do. But it was clear the ruling meant that Trump should take some action to get him back. But in a public meeting today in the White House with Salvadoran dictator Nayib Bukele, Trump and key cabinet members made clear that they would absolutely not do anything to bring Garcia home.
On top of that Trump, Secretary of State Marco Rubio, Attorney General Pam Bondi, and close advisor Stephen Miller took turns reveling in their defiance, slandering Garcia, and claiming that all they had to do was allege that Garcia was “a bad guy,” a gang member, a “terrorist”—without having any evidence for this and without any court examining those allegations—and this was enough for them to lock Garcia up in an overseas dungeon and keep him there for the rest of his life.
And Trump openly discussed with Bukele the prospect of building a whole string of prisons in El Salvador, to which Trump could deport “bad people” in large numbers—U.S. citizens and noncitizens alike!
Stephen Vladeck, a law professor at Georgetown University, said that this assertion that “the government can disappear people to a foreign country with no due process and no responsibility for what happens next” amounted to “a rule-of-law crisis. If the government can do it to Abrego Garcia, they can do it to anybody.”
That is not hype—this really is opening the gates of a Nazi hell.
And on top of even that, beyond “just” shredding the right to due process for everyone in the U.S., Trump and his gang are now openly stating that he is not subject to court orders. As Bob Avakian noted in his social media message Revolution #113, “At one and the same time, they insist that they are above the law, and that Trump is the law.” As is often pointed out, the courts have no “army” with which to enforce their rulings. As Trump’s fascists control Congress, this means that there is no force within the U.S. ruling structures that can prevent Trump from doing anything.
This is a constitutional crisis on a scale not seen since the U.S. Civil War in 1861, and a moment at which everybody has to decide where they stand and what they are going to do.
