Imagine you went to an emergency room in the midst of a miscarriage, in staggering pain, losing large amounts of blood... and the doctor who saw you said, “I'm sorry, but you have to get closer to dying before I can treat you.”
That's the reality for millions of women in states across the country.
There's a national legal fight going on about whether emergency room doctors have a right and responsibility to provide abortions for women having life threatening medical emergencies. Right now, if you go to a hospital in Idaho or Texas because of a miscarriage that is threatening your life, the answer of the state is, “No, fuck you. Die!”
After Roe v Wade was overturned on a federal level, the Biden administration tried to pass a few weak laws to give some cover to caring about the lives of women. They extended an existing federal law to argue that hospitals that receive Medicare funds are required to provide emergency care, including abortion, even in states that ban abortion. This was an attempt to bypass local anti-abortion laws.
Texas immediately sued the Biden administration in opposition to this, and a fascist appeals court just sided with Texas. Idaho passed a law in opposition to this, making it a crime with a prison term of up to five years for anyone to perform or assist in an abortion, even in emergency situations. The federal government sued Idaho at the time, and now the fascist-packed Supreme Court has agreed to hear this case, but in the meantime will allow Idaho's vicious law to stay in effect.
Already, the horror stories have piled up: a woman who lost more than half her blood from a miscarriage before getting treatment, a woman forced to carry a dead fetus for two weeks, a woman forced to endure hours of labor to expel a dead fetus instead of having a simple safe abortion procedure... over and over again, emergency room doctors and nurses telling women they are not close enough to death to mandate emergency abortion care.
